Same-sex married couples have the same rights under immigration law as any other married couple. Since 2013, U.S. citizens and permanent residents have been able to petition for a same-sex spouse, and same-sex spouses can be included in employment-based and other petitions. LGBTQ+ people who fear persecution in their home country because of their sexual orientation or gender identity may also qualify for asylum.
If you have questions about your immigration options as a member of the LGBTQ+ community, contact us. We can help.
