A past immigration violation, time spent in the U.S. without status, or a criminal record can block a green card or a visa. In many cases, a waiver can forgive the problem. For example, the provisional unlawful presence waiver (Form I-601A) lets some relatives of U.S. citizens and permanent residents ask for forgiveness before they leave for their consular interview. That can greatly shorten the time a family spends apart.
Most waivers require proof that a U.S. citizen or permanent resident family member would suffer extreme hardship. A strong waiver takes careful preparation, and a denied waiver can leave someone stuck outside the country. Talk with us before you file anything or travel.
