For a noncitizen, a guilty plea to even a minor charge can lead to deportation, a denied green card, or a lost chance at citizenship. In Padilla v. Kentucky (2010), the U.S. Supreme Court held that criminal defense lawyers must advise noncitizen clients about the deportation risks of a guilty plea.
We consult with criminal defense attorneys on the immigration consequences of charges and plea offers, help identify pleas that protect a client’s immigration status, and review earlier convictions that are causing immigration problems. When a past plea needs to be revisited, David’s law partner, Yolanda Edwards, who is licensed in Georgia, handles post-conviction motions in Georgia courts while David handles the immigration side of the case. If you are a noncitizen facing criminal charges, ask your defense lawyer to talk with us before you accept any plea.
